How long does it take to get a personal injury case in court?

I was wondering about how long would it take to see a personal injury case in court? Some people have to wait like 3 years in very big cities. I live in a small town that has a population of 5300 people, the county all together have about 39000 people. ABout how long would a person have to wait living in my area?

It depends.
Generally, the statute for personal injury suits is three years from the date of injury. If your attorney tried to negotiate a settlement and was coming close to the three year deadline, then he/she likely filed a petition with the court to perserve the statute. Aftger filing, it’s just relaly hard to say how lon git can take. It depends on how many judges are in your district to take on cases, it depends on how many other suits there are and how many criminal cases are going. Sometimes it can be a really busy time and other times, it can be slow. And judges take vacations, get sick, and have holidays just like everyone else. And the same applies to the defense. However, shortly after a petition is filed, you should get a date on the docket of some kind. In your case, it wouldn’t be too much to expect that to be a year out, at least, that’s what I woudl expect if I were in your shoes.

You have a set time to file a suit depending on your state ranging from 1 year to as much as 5 depending on the circumstance. That doesn’t mean the case also has to be settled in that period of time. Once the suit is filed the process starts and runs it’s course. The filing date must be within the timeline. Lawyers drag it out hoping to wear people down to the point they settle for less. I’ve seen it happen more than once.
