If your attorney tried to negotiate a settlement and was coming close to the three year deadline, then he/she likely filed a petition with the court to perserve the statute. It depends on how many judges are in your district to take on cases, it depends on how many other suits there are and how many criminal cases are going. Sometimes it can be a really busy time and other times, it can be slow. And judges take vacations, get sick, and have holidays just like everyone else. And the same applies to the defense. However, shortly after a petition is filed, you should get a date on the docket of some kind. In your case, it wouldn’t be too much to expect that to be a year out, at least, that’s what I woudl expect if I were in your shoes.
